Contaminated land regulations have been under development since the early 1990s.

Statutory guidance

Following consultation on a 1993 White Paper entitled 'Paying for our Past', The Environment Act 1995 inserted a new section into the Environmental Protection Act 1990 called Part IIA. Legislation, regulations and statutory guidance finally came into force in April 2000.

Under these regulations, Local Authorities are required to inspect all land within their boundaries for contamination. The London Borough of Richmond upon Thames submitted a strategy to the Department of the Environment, Transport and Regions in August 2001, detailing how the authority will take a rational, ordered and efficient approach to the inspection. Formal register

Part IIA requires Local authorities as a statutory obligation to maintain a Register of Contaminated Land.

The information stored on a formal register is that relating to regulatory action and remediation. The contents are specified in the Contaminated Land (England) Regulations 2000 and briefly include the following:

  • Site Details
  • Remediation Notices
  • Remediation Declarations/Statements
  • Appeals against Notices
  • Designation of special sites
  • Notification of Claimed Remediation
  • Convictions for Offences

This formal register is maintained at the offices of the Special Projects Team, York House, Richmond Road, Twickenham. Members of the public are able to view the register free of charge during normal office hours 9.00am – 5.00pm by appointment. Requests for copies of documents must be made to the Special Projects Team and a reasonable charge may be made.
