If rented properties are not fit for human habitation because conditions are dangerous or unhealthy, tenants may be able to take their landlords to court.

The court can make the landlord carry out repairs or put right health and safety problems. The court can also make the landlord pay compensation to the tenant.

The Private Sector Housing Team may be able to assist with this process in some circumstances by conducting an inspection of privately rented properties to determine if any category 1 and/or 2 hazards exist. Landlords would have to be notified of such inspections however and if category 1 and/or 2 hazards are identified, the Council's enforcement policy would be followed in relation to them.
